As public and private interests increasingly converge in major projects and investments, new legal questions arise at the intersection of sovereign authority and commercial obligation.

 

This session will discuss how these shifts are influencing dispute resolution frameworks globally, including:

 

  • Blurring lines between contract and treaty claims: when State contracts morph into treaty disputes.
  • State-owned entities in international arbitration (consent to arbitrate, immunity, and the commercial/sovereign divide).

  • Parallel proceedings strategy: coordinating investment treaty and contract-based arbitration.
