The rapid rise of giga-projects in Saudi Arabia and across the MENA region is reshaping how large-scale construction projects are managed and delivered. Defined by accelerated timelines, technical complexity and the involvement of multiple public and private stakeholders, these projects create unique pressures that can quickly transform what are otherwise routine project disagreements into high-stakes disputes.

 

This session will examine the role of dispute boards on giga-projects and how they are shaping dispute avoidance and resolution strategies in practice, including: 

 

  1. Why disagreements on giga-projects escalate differently, and the extent to which dispute boards can realistically function as a dispute avoidance mechanism rather than a purely reactive process.
  2. The commercial and practical drivers behind the increased use of dispute boards on giga-projects, and how they compare to expert determination as a fast-track decision-making tool.
  3. Designing effective dispute board mechanisms at the contract drafting stage.
  4. Dispute boards in practice: how they operate on live projects, their effectiveness in managing escalation and maintaining project momentum, and what parties and board members must do to ensure a constructive process.
  5. Enforcement and escalation: how dispute board decisions and recommendations are treated in practice, their influence on subsequent arbitration, and the weight accorded to them by arbitral tribunals.
